The Australian launch of the Samsung Galaxy Tab 10.1 has been in limbo for a couple of months now due to a suit filed by Apple alleging that Samsung's slate infringes on some of the Cupertino firm's patents. Now it looks like the wait for the Tab 10.1 in Australia is going to continue, as the court there has decided to issue an injunction against the device, banning it from being sold until a ruling can be reached in the case between Samsung and Apple. Samsung has issued a statement in response to the ruling:
"Samsung will continue its legal proceeding against Apple's claim in order to ensure our innovative products remain available to consumers. This is a part of our ongoing legal proceeding against Apple's claim. Samsung is also confident it can prove Apple's violation of Samsung's wireless technology patents through a cross-claim filed on September 16, 2011 with the Federal Court of Australia, New South Wales. Our wireless standard patents are essential for mobile business. We will continue to legally assert our intellectual property rights against those who violate Samsung's patents and free ride on our technology."
Last month Samsung attempted to strike a deal with Apple in the Australian case in order to get the Tab 10.1 out in time for the critical holiday shopping season, but Apple ultimately passed on the agreement, saying that it wanted a ruling on its claim that the Samsung tablet infringes on Apple-patented touchscreen tech. Samsung has said that the Tab 10.1 would be "commercially dead" and that the device may be scrapped altogether if it isn't available in time for Christmas, something that's a very real possibility now that this injunction has been issued.
