Earlier this month, Typo Products was ordered to pay BlackBerry nearly $1 million for continuing to sell its original Typo Keyboard case after it had been hit with a sales ban. Now that BlackBerry has won its battle against the original Typo case, it’s set its sights on the new version.
As noted by The Hollywood Reporter, BlackBerry has filed a lawsuit against Typo Products alleging that the Typo 2 iPhone keyboard case “still blatantly copies BlackBerry’s iconic keyboard trade dress designs.” BlackBerry says that the Typo 2 also infringes on BlackBerry patents related to its “proprietary keyboard design, backlighting, and typing automation technologies.”
In its complaint, BlackBerry says that it’s seeking damages for Typo Products’ infringements as well as a ban on sales of the new Typo 2 Keyboard case.
The new Typo 2 iPhone case had its keyboard redesigned to make it not look straight-up like a BlackBerry keyboard. The Typo 2’s keyboard definitely does look a bit different, but apparently the lettering, spacing, backlighting, and more are still too similar for BlackBerry’s liking. It remains to be seen if Typo will just ignore BlackBerry’s lawsuit and continue to sell the Typo 2 Keyboard case like it did with the original Typo, but if you’ve had your eye on the Typo 2, it might be worth grabbing one now just in case Typo actually follows this sales ban.
