The iPhone 5 isn't set to go on sale until tomorrow morning, but that hasn't stopped Samsung from telling a court that it'll probably target the new device in one of its patent lawsuits involving Apple. Samsung filed a document with a San Jose court late last night explaining that it "anticipates" that it'll add the iPhone 5 to a suit that's currently making its way through the system in California. The company says that it'll amend its complaint against Apple after its had "a reasonable opportunity to examine the device," but that based on the information it currently has, Samsung believes that the iPhone 5 will infringe the same patents that it's brought against previous iPhone models in the case.
Considering the history of legal battles between Apple and Samsung and the fact that the iPhone 5 is Apple's new flagship smartphone, it's not entirely shocking to learn that Samsung is planning to go after the handset in court. In this particular case, Samsung is accusing Apple of violating eight patents, and Apple believes that Samsung has infringed on eight of its patents. It's not clear exactly how long it'll be before Samsung formally adds the iPhone 5 to its complaint, but I'm sure that the company is going to start looking it over as quickly as it can after the phone hits shelves. This case between Apple and Samsung is tentatively scheduled to go to trial in March 2014.
