Samsung's Galaxy Tab 10.1 has been having quite a bit of legal success lately in a battle with Apple over in the U.K., but it doesn't appear that those fortunes are extending across the Atlantic. Today the U.S. Court of Appeals for the Federal Circuit denied a pair of Samsung motions that have to do with the preliminary injunction against the Galaxy Tab 10.1 that Apple won last month. The Federal Circuit denied a Samsung request to stay the Tab 10.1 injunction during Samsung's appeal of the ban, and the court also decided to reject Samsung's motion to expedite its appeal.
This isn't the first time that Samsung has been denied a stay on the Tab 10.1 injunction this month, as the Federal Circuit also shot down the company's motion for an immediate stay while the court made a decision on the stay pending appeal. Now Samsung must wait until July 30, when the trial is scheduled to begin, to fight for the ability to sell the Galaxy Tab 10.1 here in the U.S. However, Florian Mueller of FOSS Patents believes that Samsung's got a bit of a challenge ahead of it since the court hasn't felt that the desire to grant the Tab 10.1 any sort of stay of its injunction. At least Samsung's got that temporary Galaxy Nexus injunction stay to be happy about, I suppose. We'll keep an eye out for more information on the Apple/Samsung legal happenings and update you when we hear more.
