Over the past couple of months, Apple and Amazon have been arguing back and forth about whether or not the Amazon Appstore infringes on Apple's trademark on the term "App Store," and today Apple has responded to Amazon's recent claim that the term "app store" is too generic to be trademarked. "Apple denies that, based on their common meaning, the words ‘app store’ together denote a store for apps,” the Cupertino firm said in an Oakland, Calif., federal court filing. Apple went on to say that because the term "app store" isn't by other companies to describe app download services, like Google and its Android Market, it can't be called generic.
The fact that Apple is so vigorously defending its "App Store" trademark isn't a surprise, although its argument that the terms "app" and "store" put together don't describe a service to get applications from kind of goes against what most people probably think. As of this writing, Amazon hasn't responded to Apple's latest argument in this trademark battle, but I'm sure we'll be hearing from the retailer sooner rather than later. Stay tuned.
