Apple and Samsung may be meeting today and tomorrow for settlement talks, but apparently that didn't stop Apple from deciding to try and slip in a motion for a preliminary injunction against the Samsung Galaxy Tab 10.1 last week. The motion was filed late Friday evening and is based on a ruling from the Court of Appeals for the Federal Circuit which backed Apple the validity of a design patent (number No. D504,889, for those interested) that has to do with the iPad. Apple is asking Judge Lucy Koh to issue a ruling without going through another hearing, and the company has suggested that Samsung be given until May 25th to issue a response.
This certainly isn't the first time that we've seen Apple go after the Galaxy Tab 10.1, as it also sought bans on the slate in both Australia and Germany. The latter of the two was successful and brought about the redesigned Galaxy Tab 10.1N. Whether or not Apple will also see success in the U.S. with this latest attempt at a preliminary injunction remains to be seen, but even if Apple does get its wish, it may not be as big deal to Samsung as it may have once been thanks to both the existing Tab 10.1N and the recent debut of the Galaxy Tab 2 10.1.
