Yesterday we saw a German court award Apple an injunction against Samsung's Galaxy Tab 10.1, blocking sales of the tablet across most of Europe. It's been revealed that the Tab 10.1 isn't the only Android slate that's draw the ire of Apple in Europe, though, as the Cupertino firm has also sued Motorola for allegedly infringing upon the design of the iPad with the XOOM. The complaint has been filed with the same Düsseldorf court that granted Apple an injunction against the Tab 10.1, although it's not yet clear whether the complaint includes a request for a preliminary injunction against the XOOM or a permanent one. Apple was also given an injunction against a German tablet manufacturer named JAY-tech that was upheld "in its entirety" after a hearing.
This isn't the first or even second time that we've seen Motorola and Apple go after one another in court, and Apple's decision to go after Motorola and the XOOM doesn't come as much of a surprise after seeing it sue Samsung in several areas across the globe. It remains to be seen exactly what will come of this latest tiff between Apple and Motorola, although Florian Mueller at FOSSPatents notes that in Germany, "a preliminary injunction can't be requested...if the right holder has been aware of an infringement for too long," meaning that Apple may not be able to file for a preliminary injunction against the XOOM.
