No surprise here, but a judge has decided to deny Apple's request for an injunction to force Amazon to immediately stop using "Appstore" to describe its Android app market. U.S. District Judge Phyllis Hamilton agreed with Apple's claims that the term "App Store" is not generic, but she did not believe that Apple had proven that Amazon using the name caused confusion in customers. A trial concerning the issue has been set for October 2012.
It remains to be seen exactly how the trial between Apple and Amazon will go down, but you've got to think that Amazon's feeling pretty good about its odds after this ruling. It'll be interesting to see how Apple responds to Judge Hamilton's decision, too. Will it keep fighting Amazon over the name or will we see things calm down a bit between the two firms?
